TERMS & PRIVACY
LAST UPDATED: MAY 30, 2026
These Terms of Service, Privacy Policy, and Cookie Policy (together, the "Terms") govern your access to and use of all websites, subdomains, mobile views, applications, APIs, embeddable widgets, directories, marketing pages, and services operated by PaperBagged LLC ("PaperBagged," "we," "us," or "our"), including without limitation: paperbagged.com (and any subdomain), searchbisbee.com (and any subdomain), the SearchBisbee community business directory, any white-label or co-branded directory host we operate (each a "Directory Host"), our published agent / AI endpoints (such as agent-markdown, llms.txt, and /api/agent), our admin and support surfaces, and any affiliated, successor, or future property we operate (collectively, the "Platform"). The Terms apply to you whether you visit, register an account, submit a listing, edit a listing, post a review or rating, save businesses, purchase an advertisement, query an API endpoint, or otherwise interact with the Platform in any role.
By accessing or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Terms of Service
A. Acceptance & Eligibility
By accessing the Platform you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms. Use of the Platform is prohibited where prohibited by law.
B. Account Registration & Security
Some features require you to register an account. You agree to provide accurate information, keep it current, and maintain the confidentiality of your credentials. You are solely responsible for all activity under your account. You may not share, sell, or transfer your account. We may suspend, terminate, or delete any account at our sole discretion, at any time, for any reason, with or without notice or liability. You may close your account by contacting us; certain content (for example reviews) may remain published under an anonymized identifier where required to preserve the integrity of public information.
C. User-Generated Content & License Grant
The Platform allows users to submit business listings, edit existing listings, post reviews and ratings, save businesses to private lists, upload images and logos, and otherwise contribute content (collectively, "User Content").
- License Grant. You retain ownership of your User Content. By submitting it you grant PaperBagged a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and moderation purposes), display, distribute, and otherwise use your User Content in connection with operating and promoting the Platform and the businesses listed on it.
- Warranties. You represent and warrant that (i) you own or control all rights to your User Content, including any images, logos, and text; (ii) your User Content does not infringe any copyright, trademark, right of publicity, or other right of any third party; (iii) all information you provide is accurate to the best of your knowledge; and (iv) your submission complies with all applicable laws.
- Public by Default. All User Content (other than your saved lists, account email, and other items we explicitly designate as private) is public. Do not submit anything you do not want to be publicly accessible.
- Moderation. We may, at our sole discretion and without notice or liability, monitor, edit, anonymize, reject, hide, or delete any User Content for any reason, including violations of these Terms or our Content Standards.
D. Community Conduct & Prohibited Uses
You agree not to use the Platform to:
- Post content that is unlawful, defamatory, libelous, threatening, harassing, abusive, hateful, discriminatory, sexually explicit, fraudulent, deceptive, or that depicts or promotes violence against any person or group.
- Impersonate any person or entity, or misrepresent your affiliation with any person or business.
- Doxx, expose, or share the personal information (address, phone, identity) of any third party who has not consented.
- Interfere with, disrupt, probe, or test the security of the Platform or its underlying infrastructure; attempt to gain unauthorized access; or bypass technical controls including rate limiting, bot challenges, or authentication.
- Engage in automated access, scraping, crawling, harvesting, or bulk extraction of any data on the Platform, except via published API endpoints under their published terms and reasonable rate limits.
- Use, copy, or republish the Platform's data to train, fine-tune, or otherwise develop any machine-learning or large-language model, except with our express prior written permission.
- Use the Platform for spam, search-engine manipulation, link-farming, affiliate stuffing, or any other commercial activity not expressly permitted by these Terms.
E. Reviews, Ratings & Community Features
Reviews and ratings are a core social feature of the Platform. By posting a review you represent that:
- The review reflects your honest, personal experience with the business as a customer.
- You have no material relationship to the subject business (you are not its owner, employee, contractor, immediate family member, or direct competitor) and you have not received any payment, free product, discount, or other consideration in exchange for the review.
- Your review does not contain defamatory statements, threats, slurs, third-party personal information, or copyrighted material you do not own.
PaperBagged is an interactive computer service and a neutral platform for the publication of User Content. We do not adopt, endorse, verify, or guarantee any review. Subject businesses may respond publicly. We may, at our sole discretion, remove, hide, anonymize, or take other action on any review for any reason, including suspected inauthenticity, conflict-of-interest, terms violations, or legal request. Removal is not an admission of fault by anyone. To the maximum extent permitted by law, including 47 U.S.C. § 230 ("Section 230") in the United States, PaperBagged is not the publisher or speaker of User Content and is not liable for it.
Saved-list / favorites information is private to the account that created it. We may use aggregate, de-identified saved-list data to improve recommendations and surface popular businesses.
F. Business Directory Submissions, Uploads & Edits
The directory is community-maintained. Any user — including users who are not the business owner and users who do not have an account — may submit a new business listing, propose edits to an existing listing (including changing name, address, phone, hours, categories, description, and other fields), upload a logo or photos, suggest removal, or mark a business as closed. By doing so you warrant that:
- The information you provide is accurate to the best of your knowledge and submitted in good faith.
- If you include contact details (email, phone, address) for a business you do not own, those details are lawfully sourced from publicly available information or you have authority to share them.
- You own or have explicit permission to upload every image, logo, or other file you submit, and the upload does not infringe any copyright, trademark, right of publicity, or other right of any third party.
- You are not impersonating the business, its owner, or any other person.
- Your edits to listings that you do not own represent your good-faith effort to improve accuracy — not a vendetta, a paid promotion, or an effort to harm a competitor.
- You understand the listing will become public once approved, may remain public indefinitely (including after you close any account), may be displayed and indexed by third-party search engines and AI agents, and may be further edited by other users.
Every submission is recorded with a status of PENDING until a human moderator reviews it. We may, at our sole discretion and at any time, approve, edit (for length, formatting, accuracy, deduplication, or compliance), merge with another listing, split into multiple listings, re-categorize, reject, hide, or remove any submission — with or without notice and without liability. Approval is not guaranteed and review may take an unspecified amount of time. Pending submissions create no rights for the submitter and no obligation by us.
Anonymous edits are permitted. We may, but are not required to, retain non-public internal logs of who submitted what (IP, user agent, timestamp, account if any) for security, abuse prevention, and legal-process compliance — see Section G (Community-Maintained Directory Status & Platform Immunity). Inclusion in, or removal from, the directory does not imply any relationship between PaperBagged and the listed business and does not constitute endorsement.
G. Community-Maintained Directory Status & Platform Immunity
The Platform's directories (including, without limitation, the SearchBisbee.com community business directory and any other Directory Host we operate) are community-maintained collections of factual information about businesses. PaperBagged does not author, originate, or vouch for the business information, reviews, ratings, photos, or other User Content displayed on the Platform. We rely on, and you agree to, the following protections:
- Interactive Computer Service. PaperBagged LLC is a provider of an "interactive computer service" as defined in 47 U.S.C. § 230(f)(2). To the maximum extent permitted by law, the Platform is not the publisher or speaker of any User Content under 47 U.S.C. § 230(c)(1). Hosting, displaying, indexing, summarizing, distributing, or providing search over User Content does not constitute adoption or endorsement of that content.
- Good-Samaritan Moderation. Under 47 U.S.C. § 230(c)(2), we may — in good faith and in our sole discretion — screen, edit, restrict access to, hide, anonymize, demote, or remove any User Content we consider objectionable for any reason, and we may decline to take any of those actions, in each case without becoming the publisher of any other User Content and without waiving any safe-harbor or immunity. Inconsistent or selective moderation does not waive these protections.
- State Platform Immunity. To the maximum extent permitted by Arizona law and the law of any other jurisdiction whose protections are available to us, we claim all applicable platform-immunity, distributor-immunity, intermediary-liability, and online-publisher protections.
- Factual Public Business Information. Basic identifying information about a business — including trade name, doing-business-as names, physical address, mailing address, telephone numbers, public website, posted operating hours, advertised services, categories, and similar publicly-known facts — is publicly available factual information. We may lawfully publish, display, index, and let users edit such information whether or not the business owner has affirmatively consented to the listing, and we are not required to obtain, document, or maintain a business's consent in order to include it. Inclusion is not an assertion that any relationship exists between the listed business and PaperBagged. A business's preference not to be listed does not, by itself, oblige us to remove accurate factual information about it; see the business-owner remedies below.
- Community Edits Are User Content. Edits, additions, photos, hours updates, closure flags, and other contributions are User Content from the editor — not from the business that is the subject of the edit. Anonymous edits are permitted. We may, but are not required to, merge duplicate listings, correct typos, edit for length and clarity, re-categorize, deduplicate, or revert any edit at our discretion. A subject business that disagrees with an edit may pursue the business-owner remedies below.
- Business-Owner Remedies. A business identified in the directory (acting through a verifiable owner or authorized representative) may request: (i) correction of a specifically identified factual inaccuracy, supported by evidence; (ii) removal of a listing where the business is permanently closed, never existed, or where inclusion would be unlawful; (iii) a "marked closed" notation; or (iv) the listing-claim and verification process in Section H. We will review each request in good faith but are under no obligation to remove or alter accurate factual information at a business's preference, and we are under no obligation to mediate disputes between a business and the user(s) who contributed content about it.
- First Amendment & Anti-SLAPP. The Platform's publication of factual business information, user reviews, ratings, and editorial moderation are forms of speech and reporting on matters of public interest. To the maximum extent permitted by law, we reserve all First Amendment, state and federal anti-SLAPP, fair-report, neutral-reportage, and free-speech defenses available to us. Where you have contributed User Content, those defenses also belong to you personally; our independent hosting of User Content is independently protected.
- Identity of Anonymous Contributors. We will not voluntarily disclose the identity, IP address, or contact information of any anonymous contributor, editor, or reviewer except (i) in response to facially valid legal process (subpoena, court order, or government request that we determine in good faith we are required to honor); (ii) with the consent of the contributor; (iii) where necessary to protect the rights, property, or safety of PaperBagged, our users, or the public; or (iv) as permitted by applicable law. Where lawful, we may — but are not required to — notify the affected contributor before complying.
- No Endorsement, No Verification, No Guarantee. Our publication of any listing, edit, review, rating, photo, or advertisement is not an endorsement, verification, certification, warranty, or guarantee of the business, the User Content, or any transaction with the business. See Section M for the full no-endorsement / no-verification / assumption-of-risk disclaimer.
H. Owner Verification & Listing Claims
A business may be listed on the directory whether or not its owner participates. The owner (or an authorized representative) may claim a listing by contacting us at [email protected] from a domain-matched email (e.g. an address on the business's own domain) or by providing other reasonable proof of ownership (utility bill, business license, government registration). Upon verification we may flag the listing as "verified," allow the owner to manage the listing's accuracy, and route relevant communications (such as review notifications) to the verified owner.
Verification reflects only that we received reasonable evidence of ownership at the time of claim; it is not a guarantee of identity, ongoing ownership, business legitimacy, quality, or safety. We may revoke a verification at any time, including upon receipt of a counter-claim, change in ownership, complaint, or our inability to re-verify. Verified owners are bound by all User Content rules in this Agreement and gain no editorial control over reviews, ratings, third-party listings, or community content. Disputed claims are resolved at our sole discretion, and we may, in our discretion, decline to recognize any claim that we cannot reasonably verify.
I. Payments, Advertising & Refunds
If you purchase a paid advertisement, sponsored placement, or other paid feature, you agree to provide current, complete, and accurate billing information. Payments are processed by third-party processors (such as Stripe). Pricing, formats, and availability of paid features may change without notice. Advertisement performance (impressions, clicks, IP addresses, user agents) is tracked for fraud prevention, billing, and reporting. Anonymized or aggregate performance data may be shared with the advertiser.
Refund Window. Except as required by applicable law, all sales are final and non-refundable, subject to the following limited exceptions:
- Unstarted runs — full refund within 24 hours. If you request a refund within twenty-four (24) hours of purchase and your advertisement has not yet started running (no impressions served), we will issue a full refund to the original payment method, less any non-refundable processing fees charged by the payment processor.
- Removed by us for non-violating reasons — prorated refund. If we remove your advertisement before its scheduled end date for reasons not related to a violation of these Terms (for example, because we discontinue the format, change ad policy in a way that affects your active campaign, or experience an extended service outage that materially prevents delivery), we will issue a prorated refund for the unrun remainder of the campaign, calculated on a per-day basis from the day delivery stopped.
- Removed by us for a Terms violation — no refund. If we remove your advertisement for a violation of these Terms, our Content Standards, or applicable law (including but not limited to deceptive claims, prohibited content, fraud, chargeback initiation, or repeated user complaints), no refund will be issued and we may withhold any future credits, suspend related accounts, and pursue chargeback recovery.
- Operator error. If we make a clear billing error (duplicate charge, charge for a feature you did not purchase), notify us within sixty (60) days and we will reverse the erroneous charge.
Refund requests must be sent to [email protected] and include the original receipt identifier. We will respond within ten (10) business days. Initiating a chargeback or payment dispute before contacting us is grounds for suspension of associated accounts and listings.
J. Notifications & Communications
By creating an account, submitting a directory entry, contacting us, or purchasing an advertisement, you consent to receive transactional emails related to that activity (account confirmation, submission status, password resets, payment receipts, advertisement status). Marketing or newsletter emails are sent only after a separate opt-in and include an unsubscribe link in compliance with the U.S. CAN-SPAM Act and applicable equivalents.
K. Geolocation Services
Certain features (such as "Near Me" sorting) request your device's geographic location through your browser's standard geolocation API. Your browser will prompt you for permission. Coordinates are used in your browser to sort results and are not transmitted to or stored by PaperBagged servers. You may decline or revoke this permission at any time in your browser settings.
L. API, AI Agents & Automated Access
We publish certain endpoints (including agent-markdown.php, llms.txt, and the /api/agent route) to allow AI assistants and integrations to read business data on behalf of end users. By accessing these endpoints you agree:
- Access is limited to providing in-context responses to real, contemporaneous end-user queries. Bulk download, mirroring, or warehousing of the directory is prohibited.
- You will not train, fine-tune, or otherwise develop AI or LLM models using data retrieved from the Platform without our prior written permission.
- You will respect any rate limits, robots directives, and access controls we publish or implement.
- You will attribute the source where reasonably possible and will not misrepresent PaperBagged content as your own.
M. Disclaimer of Endorsement & Accuracy
The Platform is a community-driven directory. We act as a platform for the distribution of information.
- No Endorsement. Inclusion of any business, service, event, review, rating, or advertisement does not constitute endorsement, recommendation, or guarantee by PaperBagged.
- No Verification. We do not verify the accuracy, completeness, safety, legality, or current status of any User Content. Hours, addresses, prices, ownership, and operational status may change at any time without notice.
- Assumption of Risk. Your interactions with any business, individual, or organization listed on or contacted through the Platform are solely between you and that party. Any reliance you place on information found on the Platform is strictly at your own risk.
N. Third-Party Services & Links
The Platform integrates with and links to services operated by third parties, including (but not limited to) Stripe (payments), Cloudflare (network security and bot mitigation), Cloudflare R2 (image storage), Google Maps and Street View (mapping), and SMTP providers (email delivery). Your use of those services is governed by their own terms and privacy policies. PaperBagged is not responsible for the content, availability, accuracy, security, or practices of any third-party service.
O. Copyright, DMCA & Designated Agent
We respect intellectual-property rights and comply with the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
Designated Agent. Send all DMCA notices to:
PaperBagged LLC — DMCA Agent
Email: [email protected]
A valid takedown notice under 17 U.S.C. § 512(c)(3) must include:
- A physical or electronic signature of the copyright owner or an authorized agent;
- Identification of the copyrighted work claimed to have been infringed;
- The exact URL(s) or sufficient location of the allegedly infringing material on the Platform;
- Your full name, mailing address, telephone number, and email;
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Counter-Notification. If material you posted was removed under a DMCA notice and you believe it was removed by mistake or misidentification, you may send a counter-notification to [email protected] that includes: (a) your physical or electronic signature; (b) identification of the material that was removed and the location at which it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification; and (d) your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for the district where you reside (or, if outside the U.S., for the District of Arizona) and that you will accept service of process from the person who provided the original notification or their agent. If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant files a court action.
Repeat-Infringer Policy. We will, in appropriate circumstances, suspend or terminate the accounts of users and advertisers who are determined to be repeat infringers, and we may remove or disable access to listings, content, and advertisements associated with them. Sending a knowingly false DMCA notice or counter-notification may subject the sender to liability under 17 U.S.C. § 512(f) and grounds for account termination.
P. Service Availability
The Platform is provided on a best-efforts basis. We make no warranty that the Platform will be uninterrupted, error-free, secure, or available at any particular time. We may modify, suspend, or discontinue any feature at any time without notice or liability.
Q. Beta & Experimental Features
From time to time we may release features that are explicitly or implicitly labeled "beta," "experimental," "preview," or otherwise identified as not-yet-stable (for example, AI agent endpoints, new search modes, location-based sorts, or other in-development functionality). Beta Features are provided "AS IS" and "AS AVAILABLE" with no service-level commitments of any kind. We may change, restrict, replace, or remove any Beta Feature at any time without notice, may collect additional diagnostic telemetry to evaluate them, and may treat your use of a Beta Feature as your acceptance of any feature-specific addendum we publish. To the maximum extent permitted by law, PaperBagged has no liability whatsoever for any loss, damage, or harm arising out of or relating to Beta Features, and the liability cap in Section S applies with full force to all Beta Feature claims. Stable, generally-available features remain governed by the rest of these Terms.
R. Indemnification
You agree to defend, indemnify, and hold harmless PaperBagged LLC, its members, officers, contractors, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, judgments, fines, losses, costs, and expenses (including reasonable attorneys' fees and the cost of defense, even where no judgment is entered) arising out of or related to:
- your access to or use of the Platform in any role (visitor, account holder, editor, reviewer, advertiser, claimant, or API consumer);
- any User Content you contribute — including listings you submitted for businesses you do not own; edits, photos, hours, categories, descriptions, or other changes to any listing; reviews, ratings, comments, or replies you posted; and any image, logo, or file you uploaded;
- any inaccuracy, misrepresentation, defamation, or invasion of privacy or publicity right contained in your User Content, including claims by a listed business that an edit, review, photo, or other contribution you made caused it injury;
- any infringement or alleged infringement of copyright, trademark, trade dress, patent, trade secret, right of publicity, or other intellectual-property right by your User Content;
- any claim by a business owner, employee, or authorized representative arising from your submission, edit, listing-claim, or other contribution related to that business;
- any dispute, transaction, or interaction between you and another user, any business listed on the Platform, any advertiser, or any third party you found through the Platform;
- your violation of these Terms, of any rule, policy, or guideline incorporated into them, or of any applicable law; and
- any claim that you have caused damage to a third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You may not settle any claim subject to indemnification without our prior written consent.
S. Disclaimer & Limitation of Liability
THE PLATFORM AND ALL CONTENT, USER CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPERBAGGED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAPERBAGGED OR ITS MEMBERS, OFFICERS, CONTRACTORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, GOODWILL, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Liability Cap. Our aggregate liability to you for all claims arising out of or relating to the Platform shall not exceed the greater of (a) USD $100 or (b) the total amount you paid to PaperBagged in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.
T. Mandatory Binding Arbitration & Class-Action Waiver
READ CAREFULLY. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding individual arbitration administered under the rules of a mutually agreed arbitration provider, seated in or near Cochise County, Arizona, USA, and not in court (other than small-claims actions). You and PaperBagged each waive any right to a jury trial and to participate in a class action, consolidated proceeding, or representative arbitration. If this waiver is held unenforceable, the rest of this Section survives.
Opt-Out. You may opt out of this arbitration agreement by sending a written notice to our contact address within thirty (30) days of first accepting these Terms; the notice must state your full name and email and an unambiguous statement that you opt out of arbitration.
U. Termination & Survival
We may suspend or terminate your access to the Platform, your account, your listings, or your advertisements at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Sections concerning User Content license, indemnification, disclaimers, limitation of liability, arbitration, class-action waiver, governing law, and any other terms that by their nature should survive termination, shall survive.
V. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
W. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, governmental action, labor disputes, internet or telecommunications outages, hardware or software failures, denial-of-service attacks, or unavailability of third-party services.
X. Modifications to These Terms
We may revise these Terms at any time. Material changes will be reflected in the "LAST UPDATED" date above. Your continued use of the Platform after a revision constitutes acceptance of the revised Terms.
Y. Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles. Subject to Section T (Arbitration), any action that may proceed in court shall be brought exclusively in the state or federal courts located in Cochise County, Arizona, and you consent to the personal jurisdiction of those courts.
2. Privacy Policy
This Privacy Policy describes how PaperBagged LLC collects, uses, discloses, and protects personal information across the entire Platform (defined in Section 1.A), including paperbagged.com, searchbisbee.com, the SearchBisbee community business directory, our API and AI-agent endpoints, our admin and support surfaces, and any white-label or affiliated Directory Host we operate. It applies whether you visit anonymously, register an account, submit or edit a listing, post a review, save a favorite, purchase an advertisement, or query an API endpoint.
A. Information We Collect
We practice data minimization — we collect only what we need to operate the Platform. Categories of information include:
- Account Data. Display name, email address, hashed password, and creation timestamp when you register.
- Submission & Review Data. Business listings, edits, reviews, ratings, comments, and any images you upload, plus the email you provide on the submission form for status updates.
- Saved Lists. The set of businesses you have marked as favorites.
- Communications. Names, email addresses, and message bodies submitted through contact, password-reset, or report forms.
- Advertising Data. Advertiser account details, ad copy, ad images, payment receipt identifiers from Stripe (we do not see or store card numbers), and ad-performance telemetry (impressions, clicks, IP, user agent, referrer).
- Technical & Security Data. IP address, browser user agent, screen resolution, referrer, page URL, request timestamps, CSRF tokens, and Cloudflare bot-challenge data. Used for security, abuse prevention, and basic analytics.
- Cookies & Local Storage. Session cookies, theme preference, cookie-consent state. See Section 3 below.
- Geolocation. Only if you actively use the "Near Me" feature and grant browser permission. Coordinates remain in your browser; they are not transmitted to our servers.
We do not knowingly collect biometric data, precise device identifiers beyond your IP, government IDs, or any "sensitive personal information" as defined by California's CPRA.
B. How We Use Information
We use the information we collect to:
- Operate, maintain, and improve the Platform and its directory, review, and advertising features.
- Authenticate accounts, prevent fraud and abuse, and enforce our Terms.
- Respond to your inquiries, deliver transactional emails (submission status, password resets, ad receipts), and, if you have separately opted in, send newsletter content.
- Process payments through our payment processor.
- Provide advertisers with aggregate or anonymized performance reports.
- Comply with legal obligations and respond to lawful requests from public authorities.
We do not sell, rent, or trade your personal information. Information you submit to a public-facing feature (listing, review, comment) is, by design, public.
C. Disclosure to Service Providers
We share the minimum data necessary with these processors, each of which is contractually or by published terms obligated to handle data securely and only for the stated purpose:
- Stripe — processes advertisement payments.
- Cloudflare — DDoS protection, edge caching, and the Turnstile bot challenge.
- Cloudflare R2 — storage of uploaded images.
- Google Maps — map tiles, static map images, and Street View.
- SMTP / email-delivery provider — transactional and newsletter email transport.
- Google Analytics (if consented) — aggregate traffic and behavior analytics.
We may also disclose information when required by law, subpoena, or court order; to protect our rights, property, or safety, or that of our users or the public; or in connection with a merger, acquisition, or sale of all or part of our assets (in which case we will provide reasonable notice).
D. Data Retention & Your Choices
We retain personal data only as long as needed for the purposes described, then delete or anonymize it. Account data is retained for as long as the account is active and for a reasonable period thereafter for fraud-prevention and dispute-resolution. Advertisement records are retained for legal/accounting purposes (typically seven (7) years). Public directory content may be retained indefinitely as part of the directory record, even after the submitter's account is closed; in that case the content may be anonymized.
You may at any time request to:
- Access the personal data we hold about you;
- Correct inaccurate or out-of-date data;
- Port / export a copy of your account data (account profile, your submitted listings, your reviews, and your saved list) in a machine-readable format such as JSON;
- Restrict or object to certain processing;
- Delete your personal data, subject to retention obligations described above; and
- Withdraw consent for any processing based on consent (such as marketing emails or non-essential analytics) at any time.
Submit requests by contacting us at the address in Section 4. We will verify the request to prevent unauthorized disclosure and will respond within the time required by applicable law.
E. Security
We use HTTPS (TLS) encryption, CSRF token validation, parameterized database queries, server-side input sanitation, rate limiting, Cloudflare Turnstile, hashed-and-salted password storage, and routine dependency review. No transmission or storage method is 100% secure. In the event of a confirmed data breach affecting your personal data, we will notify you and any required regulator without undue delay.
F. Children's Privacy
The Platform is not directed to children. We do not knowingly collect personal information from anyone under 16 (or the higher age required by your jurisdiction, such as the U.S. COPPA standard of 13 with verifiable parental consent). If you believe a child has provided us personal information, contact us at the address in Section 4 and we will promptly delete it.
G. California Residents — CCPA / CPRA
California residents have the right, subject to verification, to: (i) know what categories of personal information we collect, the sources, purposes, and disclosures; (ii) request deletion of personal information; (iii) request correction of inaccurate personal information; (iv) opt out of any "sale" or "sharing" of personal information — we do not sell or share personal information for cross-context behavioral advertising; (v) limit use of any sensitive personal information — we do not collect any. You also have the right not to be discriminated against for exercising these rights.
H. EU / UK / EEA Residents — GDPR / UK GDPR
If you are located in the EU, UK, or EEA, our lawful bases for processing are: (a) legitimate interests in operating, securing, and improving the directory and its community; (b) consent for non-essential cookies and newsletter subscriptions, which you may withdraw at any time; (c) contract for paid advertising services; and (d) legal obligation for tax, accounting, and lawful-request compliance. You have the rights of access, rectification, erasure, restriction, portability, and to object to processing. You have the right to lodge a complaint with your supervisory authority.
I. Changes to This Policy
We may update this Policy from time to time. The "LAST UPDATED" date at the top reflects the latest revision. Material changes will be highlighted on the Platform.
3. Cookie & Tracking Policy
A. Essential Cookies & Local Storage
We use a small number of strictly necessary cookies and browser storage items: a PHP session cookie, a CSRF token, a cookie-consent flag, a theme preference, and a few interface preferences (such as the dismissed-FAB state). These are required for the site to function securely and cannot be disabled.
B. Analytics & Third-Party Cookies
With your consent (where required by law), we may load Google Analytics and other standard analytics tools to monitor site performance. Third-party content embedded on our pages (maps, payment widgets, bot-challenge frames) may set their own cookies under their own policies. You can adjust your browser settings or our on-site consent banner to refuse non-essential cookies.
4. Contact
Use the right address for the fastest response:
- General support, privacy rights, account & listing requests, opt-out of arbitration, refund requests: [email protected] or the Initiate Contact form.
- DMCA takedown notices & counter-notifications (Section O): [email protected].
Please include enough detail — account email, business or listing involved, exact URLs, and dates — for us to verify the request and respond appropriately.
